Acceptable Use Policy

1. Overview
This Acceptable Use Policy ("AUP") governs the use of SceneSmith's AI video and image generation platform. It is designed to protect our users, our platform, and the public from harmful or illegal content.
By using SceneSmith, you agree to comply with this AUP in addition to our Terms of Service. Violations may result in content removal, account suspension, or termination.
2. Prohibited Content Categories
2.1 Child Safety (Zero Tolerance)
ZERO TOLERANCE POLICY
Any attempt to generate child sexual abuse material (CSAM), content sexualizing minors, or any inappropriate content involving children will result in:
- Immediate and permanent account termination
- Reporting to law enforcement authorities
- Cooperation with criminal investigations
This includes but is not limited to:
- Sexual or suggestive imagery of minors
- Minors in violent, harmful, or dangerous situations
- Content that could be used to groom or exploit children
- Age-inappropriate scenarios involving children
2.2 Non-Consensual Intimate Content
Strictly prohibited:
- Generating nude, sexual, or intimate imagery of any real person without their explicit consent
- "Revenge porn" or content intended to harass or humiliate
- Deepfake pornography depicting real individuals without consent
- Content that could reasonably be mistaken for real intimate imagery of an identified person
2.3 Violence and Gore
Do not generate content depicting:
- Realistic violence, torture, mutilation, or graphic injury to humans or animals
- Execution, murder, or death scenes presented realistically
- Content glorifying or promoting violence against any group
- Detailed instructions or encouragement for violent acts
Exceptions: Stylized, clearly fictional, or historically educational content may be permitted with appropriate context. Contact us if you have questions about specific use cases.
2.4 Terrorism and Extremism
Prohibited content includes:
- Propaganda for terrorist organizations
- Content promoting, recruiting for, or glorifying extremist ideologies
- Instructions for terrorist acts or mass violence
- Symbols, imagery, or messaging associated with hate groups or terrorist organizations
2.5 Hate Speech and Discrimination
Do not create content that:
- Promotes hatred or discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
- Uses slurs, dehumanizing language, or harmful stereotypes
- Incites violence or harassment against any group
- Denies or trivializes historical atrocities (genocide, slavery, etc.)
2.6 Self-Harm and Suicide
Prohibited:
- Content glorifying, encouraging, or providing instructions for self-harm
- Suicide methods, planning, or encouragement
- Pro-eating disorder content promoting dangerous behaviors
- Content that could trigger or worsen mental health crises
2.7 Illegal Activities
Do not generate content related to:
- Drug manufacturing or trafficking
- Weapons manufacturing (especially illegal weapons)
- Human trafficking or exploitation
- Fraud schemes, scams, or financial crimes
- Hacking, malware, or cyberattacks
- Any activity illegal in your jurisdiction or Puerto Rico (our governing jurisdiction)
2.8 Misinformation and Deception
Prohibited uses include:
- Fake news or propaganda designed to appear as legitimate journalism
- Synthetic media intended to deceive viewers about events, statements, or identities
- False emergency alerts or crisis hoaxes
- Election misinformation or content intended to suppress voting
- Health misinformation that could cause physical harm
- Impersonation of public officials, journalists, or authority figures
3. Real Person Likeness and Deepfakes
3.1 General Rule
You may not generate content depicting identifiable real people without their documented consent. This applies to:
- Visual likeness (face, body, distinctive features)
- Voice (using voice synthesis to replicate a real person)
- Distinctive mannerisms, catchphrases, or personal style
3.2 Consent Requirements
If you have consent to depict a real person, you must:
- Obtain written consent specifying the scope of permitted use
- Inform the person that AI will be used to generate content
- Retain consent documentation for your records
- Provide proof of consent upon our request
- Respect any limitations or revocations of consent
3.3 Public Figures Exception
Limited exceptions apply for public figures in:
- Satire and parody: Clearly labeled as such and unlikely to deceive
- Educational content: Historical or factual context
- News commentary: Legitimate journalistic purposes
- Fan art: Non-commercial, non-defamatory creative expression
Even for public figures, you may NOT create content that is defamatory, sexually explicit, or depicts illegal activities.
3.4 Deepfake Disclosure
If you create synthetic media depicting any real person (with consent), you must:
- Clearly label the content as AI-generated or synthetic
- Not remove or obscure any platform-applied labels or watermarks
- Comply with regional deepfake disclosure laws (EU, US state laws, etc.)
4. Intellectual Property
4.1 Copyright
Do not use SceneSmith to:
- Reproduce copyrighted works without authorization
- Generate content substantially similar to protected works
- Create derivative works that infringe on original copyrights
- Bypass copyright protections or digital rights management
4.2 Trademarks
Prohibited uses include:
- Using brand logos, mascots, or trade dress without authorization
- Creating content that suggests false endorsement or affiliation
- Counterfeit product imagery or promotional materials
- Domain squatting or brand impersonation
4.3 Third-Party Content
If you upload reference images or materials, you must have the right to use them. You are responsible for any infringement claims arising from your uploads.
5. Commercial Use Restrictions
5.1 Advertising Standards
Commercial content must:
- Be truthful and not misleading
- Disclose AI-generated elements where required by law or industry standards
- Not make false claims about products, services, or competitors
- Comply with advertising regulations in your jurisdiction
5.2 Testimonials and Endorsements
- AI-generated testimonials must be clearly disclosed as synthetic
- You may not create fake reviews or endorsements
- Celebrity endorsements require documented consent from the celebrity
5.3 Political Advertising
- Must comply with all applicable political advertising laws
- AI-generated political content must be labeled as such
- May not be used for voter suppression or election interference
6. Platform Abuse
Do not:
- Attempt to circumvent content filters or safety measures
- Use automated systems to abuse the platform or generate prohibited content at scale
- Share accounts or resell access to the platform
- Reverse engineer, decompile, or attempt to extract our AI models
- Interfere with platform operations or other users' access
- Submit prompts designed to test or expose system vulnerabilities
7. Enforcement
7.1 Detection
We use a combination of automated systems and human review to detect policy violations. This may include:
- Automated content filtering before and after generation
- Prompt analysis for prohibited content indicators
- User reports and community flagging
- Periodic audits of generated content
7.2 Actions
Depending on the severity and frequency of violations, we may take the following actions:

| Severe | Permanent account termination, credit forfeiture |
| Criminal / CSAM | Immediate termination, law enforcement referral |
7.3 Appeals
If you believe enforcement action was taken in error, you may:
- Submit an appeal to appeals@scenesmith.ai within 14 days
- Provide context and any evidence supporting your case
- Await review by our Trust & Safety team (typically 5-10 business days)
Appeals for CSAM-related terminations will not be considered.
8. Reporting Violations
If you encounter content or behavior that violates this policy, please report it:
- In-platform: Use the report button on any content
- Email: abuse@scenesmith.ai
- CSAM / Child Safety: safety@scenesmith.ai (prioritized review)
Reports are reviewed confidentially. We do not disclose reporter identity to the reported user.
9. Regional Considerations
Users are responsible for compliance with local laws in addition to this AUP. Specific regional requirements include:
9.1 European Union
- AI Act compliance for high-risk use cases
- Deepfake disclosure requirements
- GDPR data protection obligations
9.2 United States
- FTC disclosure requirements for AI in advertising
- State-specific deepfake laws (CA, TX, NY, etc.)
- Political advertising regulations
9.3 Other Jurisdictions
- China: Deep synthesis labeling requirements
- UK: Online Safety Act considerations
- Australia: eSafety Commissioner guidelines
10. Updates to This Policy
We may update this AUP as AI capabilities evolve and new risks emerge. We will provide reasonable notice of material changes through:
- Email notification to registered users
- Prominent notice on the Platform
- Updated effective date on this page
Continued use after changes take effect constitutes acceptance of the revised policy.
